People often confuse having a document 'notarized' with having a document 'commissioned'. This misunderstanding can lead unnecessary costs, delays in completing documents and/or the rejection of a document being submitted.
What Is A Notary Public ?
Notaries and Commissioners of Oath can both provide valuable and necessary services to the public. Commissioners are able to take both affidavits and declarations, within Ontario only, by asking you to swear or attest that the contents of a document are in fact true. When the jurisdiction extends beyond the Ontario border, to other provinces or even internationally, then the services of a Notary Public are required. In addition, a Notary Public is required to certify or attest that signatures, marks or copies of a document are in fact genuine and true.
If you require that a document be commissioned or notarized, you should carefully review the document in advance to ensure its accuracy. Notaries and commissioners do not give advice or complete the document. You should ensure that the document is completed to the satisfaction of the person or entity that has requested it. Do not sign or date the document until you are in the presence of the Commissioner or the Notary. If you require a notarial copy of the document, you will need to bring the original document with you. As always, please also bring photo identification.
